You mean photocopy right? If you have scanned copy then print it and send it to USCIS. I don't think they require it in original.

As per my knowledge as long as H1B extension is applied and is in pending status you can stay/work. Is it a perm or regular case? I had my perm approved in 2 weeks. Last time my employers did a regular and it took approx 3 months.
If it gets rejected then you can use EAD, if you have one. Otherwise i think you have to leave the country in 30 days (or 15 days, i am not sure abt this).

Foreign nationals may obtain their green cards by marriage through a U.S. citizen or lawful permanent resident (LPR). If the marriage is less than two years old at the time residence is granted, the foreign national will receive conditional resident status. The actual conditional residence card will have a two year validity date. Individuals who obtained their resident status based on a marriage less than two years are required to file Form I-751 Petition to Remove Conditions 90 days prior to the expiration date on the conditional residence card. Once the conditions are removed, the conditional resident status becomes permanent.
The petition to remove conditions should be accompanied with evidence establishing the validity of the marriage since being granted conditional resident status. Supporting documentation of a valid marriage may include:
· Birth certificates of children,
· a copy of the rent/apartment lease,
· mortgage payments,
· joint filing of tax returns,
· utility bills evidencing both names,
· copies of pictures,
· itineraries or boarding passes,

I am from Austin. I got my FP appointment scheduled on 11/13.
Labor PD: 02/20/2007, I-140 pending with Nebraska since 06/29/2007.
I submitted my I-485/765/131 on 8/1 to TSC and received by TSC on 8/2.
All Notice from TSC dtd 9/26
EAD card ordered on 10/3 and received on 10/10.

I had a soft LUD on my+spouse 485 application today. I am current for this sept but will not be in Oct. Since there are no visa numbers available, I am guessing this must be either a potential RFE or my previous company lawyers may have withdrawn my G-28 representation
Does anyone know if before an RFE , would they or did they get a SOFT LUD, is this common?
Also if my previous attorney withdrew G-28 forms, will this also result in soft lud?

I went through the same and it was fairly easy and not stressing.. you have to have copies of your passport ( the persons applying for extension and copies of the return tickets of the flights back home, you need a form : I-539 and fill it up, print it and send it with all the documentation they require, it would be advisable to have a sponsor or a person who certifies that will be financially in care of her expenses. ( forgot the form number but i think is I-139 ..please check ) and once you got all those requirements send them with 300 $ that costs the application process and in less then 4 weeks you will get a letter with either the aproval or the denial of the stay. If your I-94 expires while you wait for the form do not worry cause you are not going into illegal state while the USICIS is processing your application. GOOD LUCK !! and enjoy your ceremony !!

Hi,
I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

A friend's H1B transfer from company A to company B was denied. Since his H1B with company A is still valid and is going to expire in 3 months, he can still go back to work for company A. However, if he chooses not to work for company A and tries to find a third employer to do another transfer, is he considered out of status for these three months?

So is the economic downturn over already, if you look at the recent H1B filings it may well be the case. United States Citizenship and Immigration Services (USCIS) has updated its periodic count of FY2010 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html) filings, revealing that there has been a significant increase in the rate of filings during the month of October 2009. USCIS has stated that it has received a sufficient number of petitions to use all of the available 20,000 H-1B numbers that are reserved for individuals with advanced degrees from U.S. colleges or universities, which means that the "advanced degree" H-1B cap for FY2010 has been reached. H-1Bs for individuals with advanced degrees from U.S. colleges or universities can still be filed, but those petitions will now count toward the general H-1B cap of 65,000.
Around 6,200 cap-subject H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) petitions were filed in October 2009. This is a significant number, especially when compared to the only 1,500 filings received by USCIS in September 2009. In total, as of October 25, 2009, approximately 52,800 H-1B petitions that count against the congressionally-mandated 65,000 limit have been received by USCIS. This leaves only around 12,000 H-1B cap numbers for FY2010, without taking into account the 6,800 H-1B cap numbers that are reserved for nationals of Chile and Singapore. If all 6,800 of these "reserved" numbers are removed from the 65,000 cap along with the 52,800 H-1B cap petitions already received, there are only around 5,400 FY2010 H-1B cap numbers remaining.
As a practical matter, USCIS will likely accept well more than 5,400 additional cap cases in FY2010, as the number of cases USCIS will accept anticipates that a certain number of filings will be withdrawn or denied. Additionally, nowhere near the full 6,800 Chile/Singapore numbers have historically been actually used by nationals of Chile or Singapore. Thus, most of those numbers are applied by USCIS to the general 65,000 cap.
While USCIS is still accepting H-1B petitions for FY 2010, the recent jump in filing means that by mid December or so we will have no Visas left. My advice go ahead and file now.

My wife is on H4 and willing to apply for H1-B. Her educational qualifications
1.)High school education(12 yrs)
2.)BCA(Bachelor of Computer Applications)- 3 yrs
3.)2.5 yrs of IT experience
4.)She's also doing her M.Sc(Master of Science) in Information Technology. Currently in 2nd year and will be completing by end of 2006. (She may not have the degree certificate by April 2007).
Is she eligible to apply for H1-B for next year 2007

It looks like she is. She has three years BCA and is short of 1 year but you said she has completed one year of MSc so using that one year plus three years BCA, she will be eligible. Make sure she has one full years of MSc trancripts. If she has deffered taking exams or something like this and has not completed the required credits then she might not be. I will suggest you to fax her transcripts to an evaluator and get an evaluation. It should cost $80-100 only but you will be able to sleep at night.

I filed on jul 25 ( NSC) got transferred to TSC and got receipts on 9/27
and EAD on 10/2, but no FP as yet.
Just wondering if FP did get lost...or am i in line..
