While the article specifically mentions naturalization applications, it does not clearly limit the recommended increase only to this application. I havn't gotten mine yet. Filed on Sept 11th at VSC. Check seems to have cleared though -according to the Attorney. However I guess the delay in my case is the exception rather than the rule.
Funny thing is that we got the approval notice today! No receipt notice though.

Hi thanks a lot for the prompt reply. But I am curious to know the chances of getting my transfer petition approved from my current employer. I heard we should be in H1B status before apply for transfer and we should have minimum 3 paystubs from the employer who processed H1B.
So without having all these is there any chance to get my transfer petition approved?

- If I get a new H1 sponsored (NOT a transfer of existing H1) and join a new company in a totally different job family (New H1 is not an issue because it is from a H1 cap exempt organization)

- Also maintain the current H1 (I will continue part time work here to get minimum wage)
- Will continue my GC process with this co

Hi All
I worked for a company A till July 2006. Company A had applied for my Green Card using RIR process. I got my Labor certification approved and company A applied for I-140.
In August 2006 company B acquired company A. Company B moved me to a different physical location and different state.
Company B amended my I-140 application filed by Company A to preserve the priority date. Now company B is planning to file I-485 for this ongoing I-140 application.
My Questions:
Is there any risk for I-140 application since company B amended I-140 application filed by Company A?
I am asking so as company B moved me to a different state and labor used to file amended I-140 was based on company A and its location.

Yes, if it's the same company - I think your employer just needs to file an amendment. I would suggest you consult with your employer's lawyer to see if an amended petition is even required in your case.

Unfortunately, a 212(a)(3)(B) finding would also prevent you from getting a GC based on your marriage to a US citizen.

I am in the exact same situation. I have already filed I-140/I-485 concurrently with the substituted labor. Now the dates are current I am filling another I-485 with my approved I-140. There is nothing wrong in what we are doing, as long we explain about the earlier filling and clarify the motive of the second filling. Eventually we should withdraw one of the two based on the outcome of substituted labor/I-140.

Does anybody know what the best consulates (preferably in Mexico) to go for H1B stamps are? I am getting my H1-B transfer approved in the next weeks and I want to go ahead and get the passport stamp in order to travel.
My first H1-B I went to Ciudad Juarez Mexico, and unfortunately I arrived the morning of 9/11/01, I was able to cross onto Juarez shortly after they closed down the borders.. Bad experience all in all. took 4 days longer to get back home to San Antonio and had to take a bus.
In 2004 I went to the consulate in Matamoros and it was the worst. They DID not have a record of me ever having made an appt for a visa stamp (even though I called and scheduled one) and again, the whole ordeal took 3 days too long.
Does anybody know any good consulates? I was told Monterrey Mexico is very good. Any suggestions appreciated.

As per my little internet knowledge, is it true that for base requirements under EB2 are - MS + 0 years exp (Please correct me if i am wrong here)
I know one has to also prove that the job requires a MS degree ?? How can a lawyer suffice that requirement ?? Does 1 have to specify all latest hi-fi technologies for that ??
Are the other requirements of applying under EB2 ??
So to apply under EB2 one should belong to O*Net� JobZone 5, since i am comp eng/software developer i belong to category of O*Net� JobZone 4.
So for applying EB2 under O*Net� JobZone 4, do i have to show some experience related to that field/job ?? (Really confused about this one)

In other words, even if your education equates to a US Master's degree, you will not qualify for EB2 classification unless the empolyer can show that the job duties of the position could not be successfully performed by anyone not possessing at least a Master's degree or its equivalent.
People(I'm not talking about thread starter.. but in general) simply think that they can file EB2 as they are over qualified for EB3 or their skills are superior etc. But they forgot the clause that their JOB(or more specifically Job duties) should also qualify for EB2.
